Argentina. On 12 June 2023, the “partial revocation” of registered trademarks will come into force. This type of revocation will affect registered trademarks only in relation to those goods or services for which they have not been used in the country within the five (5) years prior to the commencement of the revocation action.
There are exceptions to trademark revocation. It does not apply, for example, if there are force majeure causes.
The revocation of a registered trademark in Argentina may be requested by any person who demonstrates a subjective right or legitimate interest in the petition.
This date was established by the amendment to the Trademark Law (Law 22.362) in 2018. As of this reform, the so-called “defensive trademarks” will not be allowed. We recall that these trademarks are those registered for goods or services for which the holder does not carry out a commercial activity.
