Collective marks

Claudio Iglesias Darriba is the only industrial property attorney in Argentina to have successfully registered “collective marks.”

These unique marks are governed by a law distinct from the general trademark law (Law 26.355) and have specific characteristics: they use a “multi-class application form,” are designated for entities focused on local or cultural development, and are free of charge. Additionally, oppositions filed against collective marks must pay twice the opposition fee set for standard trademarks.

In Argentina, the holders and users of collective marks are required to meet exceptionally strict preconditions, as established by the Law on Collective Marks and the supervisory authority.
