INPI reminds that, in matters of judicial transfers, the requirements of article 10 of INPI Resolution No. 39/11 must be met.

Article 10 – The registration of transfers derived from successions due to death, direct judicial auctions and/or adjudications and dissolutions of marital partnerships must be accredited by judicial document ordering the registration of the transfer, or by public deed of partition and /or allocation of assets. If it is carried out by official letter, it must be presented to the respective Sector of the Directorate of Legal Affairs, subsequently attaching a copy with the number assigned by said area, to the respective request form for registration of the transfer. The text of the letter must include the details of the heirs or beneficiaries, their undivided shares and the indication of who is authorized to sign the respective forms.
INPI observes that, in practice, many fail to report the Official Number that was previously assigned to them in the Legal Affairs Directorate, and accompany the copy of the Official Letter, which is also mandatory for the transfer process, according to It is established in the transcribed Article 10.
