The recent deepening of the association agreement between the European Union (EU) and Mercosur is a powerful example of this trend.
On December 6, 2024, both blocs reached new commitments, strengthening a far-reaching geopolitical, economic, and environmental alliance. This historic agreement will create a free trade area encompassing over 780 million people, bringing together the world’s second-largest economy (EU) and the fifth-largest (Mercosur). The outcome: greater investment opportunities, enhanced competitiveness, and a tangible boost to regional economic growth.
Within this framework, intellectual property takes center stage. Through this agreement, the EU and Mercosur recognize that protecting IP rights and trade secrets is essential to fostering innovation, creativity, and industrial competitiveness. As such, the agreement includes robust and modern provisions on copyrights, trademarks, industrial designs, geographical indications, plant varieties, and the protection of trade secrets.
One of the most notable features is the chapter on geographical indications (GIs)—a type of IP that protects names linked to geographical origin and traditional know-how. Mercosur will protect around 350 European GIs, such as Parma ham, Champagne, and Irish whiskey, while the EU will likewise protect emblematic regional GIs, including Mendoza wine and Brazilian cachaça. This opens up a unique opportunity for traditional Latin American products to access the European market with protected identity and added value.
Additionally, the agreement addresses the harmonization of technical regulations and standards, another key element for facilitating trade. It promotes transparency, the adoption of international standards, and mutual recognition of conformity assessments, all of which will lower costs for exporters and simplify access to new markets.
