Main Points of the Implementation of INPI Resolution P-295/24 are:
- Issuance of DNM Provision (Intimation to Payment)
A provision will be issued to notify the holders of applications with maintained oppositions, for a period of 15 business days.
It covers those who have not responded to the opposition transfer hearing and whose opposition has not issued an opinion.
Weekly provisions will be issued with approximately 3000 cases. - Notification by Publication in the Trademark Bulletin
Starting on August 14, 2024, and every following Wednesday, the notice provisions will be published in the Opposition Resolution Bulletin. - Payment of the New Fee for Opposition Writings
Intimated applicants must pay the corresponding fee (Code 170,000) through the web processing portal.
This fee is unique for each application, regardless of the number of oppositions in force.
The fee will be operational starting the week of August 5, but it must not be paid until it is notified in the Opposition Bulletin. - Denial of Requests without the Corresponding Payment
The National Trademark Directorate will deny applications without payment of the new fee, issuing the corresponding provision. - Suspension of New Notifications of Maintained Oppositions. No new oppositions held will be notified until the aforementioned notices are completed.
