New tariff for trademark applications with oppositions

On July 10, 2024, the National Institute of Industrial Property (INPI) published Resolution 295/2024, which introduces a new tariff on those trademark applications that receive oppositions in Argentina.

From now on, applicants must pay a mandatory fee for the INPI to resolve oppositions under penalty of automatic rejection of the trademark application.

The basis for this measure is found in the large number of oppositions maintained that have not received a response from trademark applicants, demonstrating a clear disinterest on the part of the applicants.

The resolution also includes a transitional clause, applicable to applications with pending oppositions, urging applicants to pay the fee or abide by the rejection of the application.
